Frequently Asked Questions

Legal guardianship and procedural representation often raise many questions. Here you will find initial answers to offer you orientation in complex situations.

Legal Guardianship

Questions about costs, rights, and the duration of the guardianship procedure.

The costs depend on the assets of the person being cared for. If the person is considered destitute, the state takes over the remuneration. If assets are present, the costs are paid from them.
Legal guardianship does not automatically mean the loss of legal capacity. Your will is at the center. The guardian supports you in defined areas of responsibility without unnecessarily restricting your fundamental rights.
Guardianship is only maintained as long as it is necessary. The court checks the necessity after seven years at the latest, but can do so earlier or lift the guardianship upon request.

Procedural Representation

Information on the role of the 'Child's Advocate' or procedural counsel.

The procedural counsel represents the interests of minors in family court proceedings. They are the voice of the child and ensure that their will and well-being are heard.
The ultimate goal is the protection of the child's well-being. We work towards finding a solution that focuses on the rights and needs of the child, often also through mediation between the parties involved.
